Terms of Service

By accessing or using XBio (“the Service”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are between 13 and 18, you confirm that a parent or guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You are responsible for maintaining the security of your account and password. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We cannot and will not be liable for any loss resulting from your failure to keep your account secure.

You may not use another person's account without permission, create accounts by automated means, or create an account with a username that impersonates another person or entity.

3. Acceptable Use

You agree not to use the Service to:

• Post, link to, or distribute illegal, harmful, abusive, threatening, or harassing content
• Infringe any copyright, trademark, or other intellectual property rights
• Distribute malware, phishing links, or other malicious code
• Impersonate any person or entity, or misrepresent your affiliation
• Spam visitors, including via the email capture, graffiti, or guestbook features
• Post content to another user's graffiti wall or guestbook that is abusive, deceptive, or advertises a third party without their consent
• Send email through the Service to people who did not opt in, or attempt to defeat the unsubscribe link we attach to every message
• Circumvent any security, rate-limiting, or access controls on the Service
• Use the Service in any way that violates applicable law

We reserve the right to suspend or terminate any account that violates these rules, without prior notice.

4. Content

You retain ownership of the content you post on XBio (profile text, links, images). By posting content, you grant us a non-exclusive, royalty-free, worldwide license to display, distribute, and cache that content solely to operate and improve the Service.

You are solely responsible for your content. We do not endorse user content and are not liable for it. We may remove content that violates these Terms or that we deem harmful to the Service or its users.

5. Credits

Credits are a virtual currency used to unlock digital items in the shop. Credits have no monetary value outside the Service and cannot be exchanged, redeemed, or withdrawn for money. They are non-transferable except via the gift feature and via Theme Marketplace sales (see Section 8), and are non-refundable except in cases of verified billing errors. Credits do not expire. We reserve the right to adjust credit prices and shop item costs at any time.

6. Pro Subscription

Pro subscriptions are billed monthly or annually via Stripe. You may cancel at any time through the Stripe customer portal. Access to Pro features continues until the end of your current billing period. We reserve the right to modify the features included in Pro with reasonable notice. Recurring subscription payments are generally non-refundable; see our Refund Policy for details.

7. Digital Items & Shop Purchases

Items you purchase from the shop (digital effects, themes, and similar) are licensed for use on your own profiles on the Service. You may use them on profiles that promote your own commercial activity. You may not transfer or resell purchased items, or use them outside the platform. This does not restrict themes you create yourself, which you may publish and sell through the Theme Marketplace under Section 8. We do not guarantee that all shop items will remain available indefinitely.

8. Theme Marketplace

Pro users may publish themes to the marketplace. By publishing a theme, you grant other users a non-exclusive license to use it on their profiles. You retain ownership of your theme designs. We may remove marketplace themes that violate these Terms or our content standards.

When another user buys your theme, they pay in credits and 80% of the sale price is added to your credit balance. This share is paid in credits only. As set out in Section 5, credits have no monetary value outside the Service and cannot be withdrawn or exchanged for money - they may be spent on the Service. We may adjust the share percentage with reasonable notice.

9. Referral Program

You may earn credits when a new user signs up using your referral code. Referrals must be genuine: creating accounts to refer yourself, using disposable or automated signups, or otherwise inflating referral counts is prohibited. We may withhold or reverse credits earned this way, and may suspend accounts that do it repeatedly. Credits awarded through referrals are ordinary credits and are governed by Section 5. We may change the referral reward, or end the programme, with reasonable notice.

10. Custom Domains

Pro users may point a custom domain at their profile. You are responsible for registering and renewing that domain, for keeping its DNS records correct, and for having the right to use it - do not connect a domain you do not control or that infringes someone else's trade mark. Domain connection depends on third-party DNS and hosting providers, so we cannot guarantee availability or propagation times.

If your Pro subscription lapses or your account is suspended, we may stop serving your profile at the custom domain; the domain itself remains yours. We may decline or discontinue serving a domain that is used to impersonate, to distribute prohibited content, or in a way that puts the Service at risk.

11. Third-Party Services

The Service integrates with third-party platforms (Stripe, Google, GitHub, Discord, Twitch, and others). Your use of those integrations is subject to the respective third-party terms. We are not responsible for third-party service availability or conduct.

12. Service Availability

We do not guarantee that the Service will be available at all times. We may modify, suspend, or discontinue any part of the Service with or without notice. We are not liable for any downtime or data loss resulting from interruptions.

13. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of viruses or other harmful components.

14. Limitation of Liability

To the maximum extent permitted by law, XBio and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

15. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time from the editor Settings page.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
